Latest Official Firmware ?

My experience accords with @MymsMan. Really, if it's 5370 and the listing says 3070 that's prima facie "item not as described" and should get you a refund through the eBay system regardless of what the seller may think.

I've had some constructive discussion with the seller now, they admit they sell the 5370 but that this must have got mixed up and they haven't had a 3070 in this casing, they have checked another themselves and had been connecting them to Linux which is using the same driver but only when you do the command Black Hole listed does it show the vendor ID/Chipset and of course as I knew and why I purchased the Humax is going to be picky as it won't have all the latest drivers from newer Linux builds.

I've been offered to return for a refund if I don't find a use for my raspberry pi, and hopefully the seller can check others and prevent the same issue.

I laughed at the baby and bath water comment - I agree I've had some regular eBay sellers I have no issue with but the marketplace on eBay and the whole headaches of dealing with issues there VS Amazon or any retail web store mean I put a lot less custom there than I did when it was a much younger business.

If I want the risk and am patient of course I'll order direct from China, it's all about how much, how quick and level of risk much like any purchase.

I totally agree.

I think it's worth messaging the seller to let them know your item doesn't work. It will allow them to change it for future customers and orders.
To be fair to the seller, I purchased mine over a year ago (from other Ebay seller). They work fine and just look like your duff unit. They were very common and were sold by many sellers, although now I don't see many of the exact model on the site. As @Black Hole has said, it may have been an old production run.
I post the results of the dmesg, lsusb and lsusb -v commands from Linux Mint on a working unit - it may help you to compare the differences.
Your seller did have the chipset and product suitability on the description so s/he may be helpful and replace or refund the unit.
Note they sell a number of usb WiFi dongles, so they may offer to replace the item.

Your picture doesn't match the picture in link that you purchased it from.
Like bottletop, I do have one which looks the same as the picture in link that you purchased it from, and like bottletop it works.

Perhaps the seller sent you the wrong dongle..
